General Assembly of High Court: We adhere to principle of separation of powers and refuse to engage in political affairs.

The General Assembly of the High Court reaffirmed Monday, its adherence to the principle of separation of powers, not exceeding the limits of its jurisdiction, and distancing itself from engaging in political affairs.

The General Assembly said in a statement it published on the court’s Facebook page: “As a result of the Supreme Court, being at the top of the judicial hierarchy in Libya, with its role entrusted to it in establishing God’s justice on His land and among His servants in this country, the Constitutional Chamber of the High Court undertakes judicial control over the constitutionality of laws in a way that achieves the subordination of all state authorities to the provisions of the law, and prevents any of the state’s authorities from exceeding their specific powers in accordance with the constitution.”

The statement added, “The General Assembly confirms its adherence to the principle of separation of powers and that it does not exceed the limits of its jurisdiction stipulated in its law and other legislation in force, and that it distances itself from engaging in issues related to political affairs, in order to preserve its impartiality and the interest of the country.”

The High Court’s statement came one day after the High Judicial Council rejected the ruling issued by the Constitutional Chamber of the High Court regarding the unconstitutionality of its formation.
